The US Constitution establishes three separate branches of government and by design, these branches create a system of checks and balances in order to protect citizens from unchecked government power. However, over the course of our nation’s history, a growing regulatory state has altered this system, via a growing cadre of executive agencies that possess all three functions of government: lawmaker, executive, and judge.
This conference will address constitutional concerns involving this “fourth branch” and examine potential legal pathways to strengthen checks and balances in American government. Topics discussed will include due process concerns with agency enforcement actions, the future of judicial deference, and legal challenges to fact-deference (“super deference”).
This event is co-hosted with the Pacific Legal Foundation.
